Former Liberty County judge will go to trial for FEMA-related fraud charges (TX)

We continue having an interest in the trial of former Liberty County Judge Phil Fitzgerald because of his past legal history of alleged probate abuse.  Background on that case can be found in our 2011 post Former Liberty County (TX) judge indicted for fraud, tied to trust dispute.

Here’s the latest:

In a stunning turn of events, the plea agreement between the federal government and former Liberty County Judge Phil Fitzgerald was rejected by U.S. District Judge Ron Clark on Friday, in Beaumont.

Clark advised Fitzgerald during the sentencing hearing that the judge did not have to accept the terms of the plea agreement and that the former county judge could face a harsher sentence and fines from the FEMA-related fraud charges.

“If we continue forward, the sentence could be more severe,” said Clark to Fitzgerald.

On Oct. 19, 2011, Fitzgerald appeared before United States Magistrate Judge Keith F. Giblin and voluntarily entered a guilty plea for one felony listed in the 27-count second superseding indictment, which was filed in July 2011.
