Attorneys for the family of the late Henry J.N. Taub were in court today to prevent former KTRK Reporter Mary-Ellen Conway from attempting to seal key documents in a lawsuit claiming she was Mr. Taub’s common law wife. Yesterday Harris County Probate Judge Kathy Stone issued nineteen Findings of Fact in the case stating that Conway was “never party to a marriage…of any type character or kind to the late Henry J.N. Taub.”
The motion filed by Conway’s attorneys asks the court to ban the news media and public from having access to key documents in the case. This includes the Co-Executors’ Motion for Sanctions, any medical records filed with the Court, both parties’ summary judgment motions and the Court’s Final Judgment and Findings of Fact.
“We are stunned that a former journalist would file a motion to prevent the public and media from accessing the records to a case the former journalist brought to the courthouse,” said Taub family attorney Don Jackson. “Ms. Conway chose to bring this lawsuit knowing full well that it would deal with personal and family related issues,” said Jackson.
Because of the serious nature of this motion the law requires public notification so that the news media can raise objections.
“Texas law discourages secret litigation,” noted Jackson. “Granting of this type of motion is extremely rare. The lawsuit has been followed by the press, and the public is now interested in the outcome. It would be unfair for my clients not to be able to point to the full record of what occurred,” he said.
