Indianapolis – The state has sued a local estate planning company over alleged violations of the Deceptive Consumer Sales Act.

Deputy Attorney General James Comeau filed the lawsuit this week against Better Estate Planning LLC and its owner, Daniel Pachuta. The state and Pachuta already have reached an agreement under which Pachuta will pay $9,000 in restitution to the state and victims.

According to court documents, Pachuta hosted estate-planning seminars at public libraries around Indiana. Some attendees bought estate plans including a trust, a will, a living will and power of attorney.

Court records show Pachuta told customers they would receive legally binding documents, even though he is not an attorney.

The Journal Gazette of Fort Wayne says it could not find a working phone number for Pachuta or Better Estate Planning.
