Estate looting 101: guarding from guardian abuse

Involuntary Redistribution of Assets (IRA) actions via misuse of probate instruments or abuse of probate venues are becoming more common occurrences.  Wills, trusts and powers of attorney generally involve property, but guardianships pose an even more potentially intrusive threat as they assign control of a person’s life and/or property to another person – maybe a complete stranger.

    I received a motion from my son’s property guardian that he wants to have me removed with the basis of his removal being lies told to him by my husband and the fact that my son told my husband that I was in the process of moving it from Brooklyn to NJ, so he wants me out.I am being railroaded by the Brooklyn court system and so is my son. He asked for legal representation at the last hearing and the Judge totally ignored him and continued with the proceedings. He then came to me and I asked for a lawyer and he told me “OK but you are going to have to pay for it yourself”. No one wants to take the case in Brooklyn, SI, and NYC. I am to appear September 18th and I do not have representation as of today I am starting to get desperate and petrified that this will go through because the judge likes the lawyer and the lawyer likes and believes my husband of all of his lies

    My husband beat up my son so severely that he received both black eyes and could not open them because the music was too loud and he is an animal and has definite anger management problems.. He broke down the door and he was arrested. He is claiming that I was the cause of the beating and I stole money from our bank accounts, which really has nothing to do with my son’s article 82 guardianship..

    If you cannot represent me can you recommend someone who can
